?講義の目的:この講義は博士後期課程の学生、社会人コース修士学生、および外国人学生を対象としたもので、全て英語で行なうものである。修士課程課目「国際コンサルティングエンジニアリング」の講義内容を契約管理の観点から、より専門的かつ実践的に捉え講義を行なう。本講義の特徴は「定量的分析に基づく契約管理技術」の修得を目的としており、建設プロジェクトの最前線で業務を遂行する者のために用意されたものである。受講者は国際建設契約約款の内容を知り、実質的な契約管理技術を学ぶことが出来る。
?講義の進め方: 国際契約約款として使用されているFIDIC約款を基本に、ケーススタディに基づく実践的講義を行なう。担当教員と国際建設契約とプロジェクトマネジメントを専門とする海外からの講師が実質的業務について講義を行ってゆく。
?達成目標: 国際建設プロジェクトのマネジメント技術と国際契約約款(FIDIC約款)の理解。定量的分析に基づく契約管理技術の修得。 |

?講義計画: 1.「Present Status and Tendency of International Construction Project」 The lecture No.1, the purpose, present situation and problems involved of the International Construction Projects, especially Japan’s ODA Loan Projects will be presented. The goal of this course shall be of better understanding the system of Japan’s ODA Loan. 2.「International Construction Projects Management (1) Outline」 Project Management is essential for the due performance of the construction projects. Project Management consists of Cost Control, Schedule Control, Quality Control, Productivity Control, Procurement Control, Communication Control and Personnel Control, and these controls shall be reflected to the contract conditions. In this connection, better understanding of Project Management is fundamental and effective elements of the Contract Administration. In lecture No.2, we study the outline of the Project Management for the international construction projects. 3.「International Construction Project management (2) cost control, schedule control, quality control」 Lecture 3 will be presented three major project controls; cost control, schedule control and quality control where theory and practice will be introduced. 4.「International Construction Projects Management (3) Three Actors Project Execution System」 In lecture No.4, we will study the respective role of the parties involved in the construction projects (stake-holders) i.e. the Employer (Owner), the Contractor, the Engineer and Lenders. Special attention will be made the important role of the Engineer in connection with the project management. The communication control between stake-holders will be also focused on. |

5.「Procurement (Tender) Management (1) Procurement guideline and standard tender documents for the selection of consultant and contractor」 Procurement (selection of consultant and contractor) is key element of the successful performance of the projects, therefore the parties involved in the projects are required the understanding its importance. We will study the procedures and notes of the procurement through JBIC procurement guideline required for effective and fair selection of consultant and contractor under Japan’s ODA Loan. 6.「Procurement (Tender) Management (2) Tender and Contract」 We will study practical points and notes relating to the preparation of tender inquiry documents, tender submission documents, tender procedures, tender evaluation and contract execution procedure for international construction projects. 7.「Contract Administration (1) Basis of International Construction Contract」 In lecture No.7, we will study the basic knowledge of international construction contracts. In comparison with Japanese contract, we are able to study the contracts widely accepted in international community. 8.「Contract Administration (2) FIDIC Conditions of Contract」 In lecture No.8, we will study FIDIC Conditions of Contract which is a de-fact standard contract conditions and is recommended to use as tender documents by JBIC. |

9.「Contract Administration (3) Employer’s (Owner’s) obligation and rights」 In lecture No.9, we will study the rights and obligation/responsibilities of the Employer referring to FIDIC conditions of contract, and also will study the instructions, tests and inspections, and approvals made by the Engineer. 10.「Contract Administration (4) Contractor’s Obligation (Responsibility) and Rights」 As 4th lecture of Contract Administration, we will study the rights and obligation /responsibility of Contractor referring to the contract conditions as well as the points of project management from the contractor’s view point. 11.「Contract Administration (5) Application for claims」 As 5th lecture of contract Administration, we will study contractor’s claim arising from construction contract, including claimable occurrence, claim procedure, additional cost claim, and time extension claim. 12.「Contract Administration (6) Evaluation of claim」 As 6th lecture of contract Administration, we will study the evaluation procedure of claim, evaluation method of claim and procedure of claim settlement. |

13.「Contract Administration (7) Settlement of Dispute」 The Engineer makes his decision of claim. However, the parties to the contract may not agree his decision of claim, in such event the dispute will arise. In this lecture, we will study the process of dispute settlement and preventive measures. 14.「Negotiation Practice for dispute (case study 1)」 The attendants try to act as the Employer, Contractor or Engineer in order to demonstrate the debate on additional cost claim, and time extension claim so that the attendants are expected to understand the contract management. 15.「Negotiation Practice for dispute (case study 2)」 The attendants try to act as the Employer, Contractor or Engineer in order to demonstrate the debate on additional cost claim, and time extension claim so that the attendants are expected to understand the contract management.
